General rental conditions

Thank you for your interest in our vacation home. The primary target groups for the vacation home are groups of friends or families who want to spend their vacation in pleasant surroundings.  Parties and/or bachelor parties are not permitted. The entire property is non-smoking and pets are not allowed (only upon special request and with the explicit permission of the owners). By making a reservation, you agree to the house rules and the general rental conditions.  

General booking conditions

When booking the vacation home, you agree to the rental conditions as described in this document. Therefore, please read them carefully before booking. These general terms and conditions apply to the “Quinta Da Cabana - hoeve” vacation home located at Travessa Da Cabana 8 - Salir De Matos, Portugal, hereinafter referred to as the “vacation home.” These general terms and conditions may only be deviated from if the landlord agrees to different terms and conditions in advance and in writing. These changes will then be stated on the booking confirmation sent by email. The tenant can therefore under no circumstances claim the application of their own general terms and conditions.

Bookings

All bookings are made directly via our website: www.quintadacabana.com. Or indirectly via booking sites (Air B&B, nature houses, etc.) which discuss their own rental conditions with the tenant. This method of booking is binding. The general terms and conditions come into effect when a booking is made. There are no booking fees associated with a booking.

Booking request and payments:

Each booking will be processed by the landlord within three days. The landlord has the right to refuse a booking if there are strong suspicions that it does not comply with the general rental conditions. After confirming the booking by email, a deposit of 30% of the rental price must be paid within five days of receiving the confirmation. The remaining amount of the rental price, together with a deposit of €400, must be received by the landlord no later than 30 days before the start of the rental period. For bookings made within 30 days before the start of the rental period, the total rental price and the €400 deposit must be paid. In the event of non-payment or late payment of the deposit and/or balance of the rental price and security deposit, the owner is entitled to cancel the booked period for the rental of the vacation home in accordance with the cancellation conditions described in the section “cancellation by tenant.” The security deposit will always be refunded in full in the event of cancellation.

Rental price

The rental price of the vacation home is described on the website and is specified in the rental agreement.

The rental price includes “normal” consumption of water and electricity. This is also quantified in the rental agreement and is based on the historical consumption of previous guests. If deliberate and/or excessive consumption is detected, the surplus will be charged, calculated on the basis of the actual excessive consumption.

Privacy & GDPR

In line with the applicable regulations regarding privacy and GDPR, the landlord will process your personal data. Under no circumstances will personal data be passed on and/or sold to third parties. When booking, the (main) booker agrees that we may collect his personal data and contact him in the future with a view to a future booking of the vacation home.

You can have your personal data modified or deleted upon simple request. This can be done by sending an email to hello@quintadacabana.com.


Liability of the tenant

The rented vacation home must be occupied by the tenant, his co-tenants, or his visitors with the required care and diligence, with due regard for the peace and quiet of the surroundings. The main tenant is liable for damage caused by him/her, co-tenants, or any visitors, even if this is discovered after his/her departure. If damage is discovered after the main tenant's departure, he/she will have to accept the landlord's decision.

The house rules, which are available in the vacation home, are an integral part of the rental agreement and must therefore be strictly adhered to. Some important points from these rules, but not an exhaustive list:

  • The tenant must ensure that no noise nuisance is caused to the neighbors. In the event of a violation, all persons will be removed from the vacation home without prior warning and without refund of rent.
  • No furniture may be moved.
  • Fires may only be lit in the fire pit/barbecue in the garden or on the terrace, unless special guidelines are issued by the government in connection with persistent drought and fire hazard.
  • Organizing bachelor parties and/or drinking parties in the vacation home is not permitted. In case of violation, the rental period will be terminated and all guests will be removed. This will be done without the tenant having any right to reclaim the remaining rent.
  • The property has a no-smoking policy. Smoking is permitted outside the vacation home, but the tenant must extinguish cigarette butts at all times (due to the risk of fire) and dispose of them.
  • Pets are not allowed.
  • Electricity usage: due to the rural nature of our farm, we have limited electricity capacity. There is sufficient power for all basic needs, but if you as a guest use all electrical appliances, air conditioning, heating, ovens, hair dryers, etc. at the same time, problems may arise. Please take this into account.

Liability insurance

The tenant is requested to be insured for damage to third parties, such as liability insurance (family insurance). The tenant is advised to insure his legal liability in the event of a fire caused by him in the holiday home concerned. Please check this with your insurance agent.

Liability of the landlord

The owner cannot accept any liability for loss, theft, damage, or injury of any kind caused to tenants of the vacation home (both inside and outside). The owner cannot accept liability for damage caused by natural disasters, nuclear disasters, attacks, strikes, acts of violence, or contact with an aircraft or parts thereof. Work may be carried out in the vicinity of the vacation home. This could include road works or construction activities, for example. We cannot accept responsibility for any noise nuisance. The landlord is not always present on site. The confirmation email for your booking, as well as the vacation rental, contains a list of contact persons and their telephone numbers. If necessary, one of these responsible persons can always be contacted.

Defects:

If a defect occurs in the vacation home during the rental period, the landlord will try to remedy this as quickly as possible. However, defects do not give rise to any form of compensation or refund of rental fees.


The landlord always tries to offer the property in perfect condition to the tenants. If, in the unlikely event, one or more defects are present at the start of the rental period, this does not give rise to any form of compensation or refund of rental fees.

Maximum number of persons/Extra persons

The house description on the website states the maximum number of persons allowed to stay in the holiday home. This number of 8 persons (adults) for Casa Adega and 4 persons (adults) for Casa Anna may not be exceeded under any circumstances. If this number is exceeded, the rental agreement will be considered legally dissolved and access to the vacation home will be refused without any claim to a refund of the rent.

Children under the age of 3 are not counted, but must be mentioned in advance.

 

Arrival and departure

Please strictly adhere to the arrival and departure times. In order to guarantee a clean vacation home, there must be sufficient time for thorough cleaning between the departure of previous guests and the arrival of new guests. If your arrival time differs, please notify us in good time. For different departure times, you can also contact us to discuss the options.

We have a communal (covered) terrace, garden, and covered parking where you can wait if you arrive early or leave late.

 

There is a lockable room for your luggage. Please note that in the event of a late departure or early arrival, the manager and any staff will be busy preparing the property for the next guests, which may cause some disturbance, such as mowing the lawn, cleaning the terraces, cleaning the outdoor area, etc.

Household waste

We sort waste as follows:

  • Residual waste - Organic waste - Plastic (can be disposed of directly in the green container, 50 meters down the road)
  • Paper and cardboard (there will be a container for paper/cardboard)
  • Glass in the designated bins

End of stay / final cleaning

The landlord attaches great importance to the cleanliness of the property. It is greatly appreciated if any damage is reported to the landlord. The rented vacation home must always be left tidy at the end of your stay. This means: tidying up the property: putting everything back in its place, cleaning the kitchen counter, putting the clean dishes in the cupboard, and leaving the vacation home tidy (swept clean). The ‘normal’ final cleaning is mandatory and paid for in advance by you. However, you will understand that we ask you to comply with the house rules. We are therefore obliged to charge additional costs if the following is not in order:

  • Emptying the dishwasher €10
  • Emptying and cleaning refrigerators or freezers €15
  • Extra cleaning of rubbish according to house rules (incorrect sorting) €15/hour
  • Cleaning the terrace €15/hour
  • Cleaning ovens, kitchen equipment, crockery, etc. €15/hour
  • Damage and shortages of inventory according to purchase invoice.

Linen

When you move into the house, a linen package and towel package are always provided. We have towels for personal use, small floor towels for the bath/shower, and a package of beach towels. We kindly request that you only use the latter at the pool and beach; for hygiene reasons, it is better to keep the regular towels in the respective bathrooms. We ask that you do not wash the sheets yourself. If there is a problem with the sheets or towels, please let us know and we will help you.

Deposit

The vacation home contains valuable items and the deposit serves to compensate for any accidents or damage. Complaints regarding the inventory and existing damage will be accepted up to 4 hours after your arrival. These must be reported to the owner or his representative on site. Accidents can happen, but immediate repair prevents further damage. The tenant is responsible for the vacation home and its contents and is expected to use them with due care. The vacation home is checked during cleaning. It is therefore during cleaning that damage, loss, or breakage can be detected. If everything is left in good order and no damage or breakage is found, your deposit will be returned by bank transfer no later than two weeks after your stay. If the damage exceeds the amount of the deposit, the tenant is obliged to make an additional payment within one week of notification. Any dispute about damage is a dispute between the owner and the tenant. The owner decides on the security deposit.

If something is broken, it is advisable to keep the broken pieces aside for the owner or the person responsible. This allows them to determine which piece is broken and prevents discussions and misunderstandings. In the event of an accident or dispute, it is best to communicate with the person responsible and/or the owner.

Cancellation

Cancellation

You can cancel a booking free of charge within 5 days of the booking date. This can be done by email (hello@quintadacabana.com). This cooling-off period does not apply to bookings made within 30 days of the start of the rental period. In the event of cancellation after these 5 days or bookings made within 30 days of the rental period, the following cancellation conditions apply.

Cancellation by the renter

Cancellations must be communicated by email to hello@quintadacabana.com. Immediately after receiving the cancellation, the lessor will send a confirmation of the cancellation by email.

For cancellations up to the 30th day before the start of the rental period, the cancellation fee is 30% of the rental price.

 

For cancellations between the 30th day and the 14th day before the start of the rental period, the costs are 60% of the rental price. 

For cancellations after the 14th day before the start of the rental period, the full rental amount is due.
